SitesLogix

Service terms

Effective 2026-10-05. These terms govern your use of SitesLogix.

01

The agreement

SitesLogix is a product of SitesMark LLC, an Arizona limited liability company (“SitesMark”, “we”, “us”), which provides it. By creating an account or using the service you agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorized to bind it, and “you” means that company.

02

Accounts and your organization

You are responsible for your account credentials and for what the people you invite do in your organization. Roles determine what each member can see and change; choosing them appropriately is your call, not ours. Tell us promptly if you believe an account has been compromised.

03

Your data stays yours

You own the records you put into SitesLogix. You grant us only the permission needed to host, process, back up and display them so the service works, and to support you when you ask. We do not sell your data, and we do not use your records to train AI models.

You can export your data while your account is active. We own the software itself, along with our trademarks and documentation; nothing here transfers that to you.

04

Acceptable use

Do not use SitesLogix to break the law, to store material you have no right to store, to attack or probe the service or other customers, to circumvent access controls or usage limits, or to resell the service without our agreement. We may suspend an account that is causing harm, and will tell you why.

05

Safety and compliance records

SitesLogix helps you record safety and compliance work. It does not perform it. Job safety analyses, hazard assessments, certification tracking, inspections and incident records are documentation tools. They are not a substitute for your own obligations under OSHA or any other law, for competent supervision, or for professional judgment on site.

Licence, certification and safety information shown in the application may come from third-party sources and may be incomplete or out of date. Verify anything you intend to rely on. You remain responsible for the accuracy of the records you keep and for meeting your legal retention requirements.

06

Fees, billing and cancellation

Paid plans are billed in advance through our payment provider, monthly or annually as you choose, and renew automatically until cancelled. Usage above your plan’s included limits is billed as described at checkout. Fees are exclusive of taxes.

You may cancel at any time; cancellation takes effect at the end of the current billing period, and we do not refund partial periods except where the law requires it. If we change prices, we will give you notice before the change applies to your renewal.

07

Support and account access

We may access account data to provide support, prevent fraud, and maintain the service. Access is logged and, except in emergencies involving fraud, legal obligations, abuse, or security, requires the organization owner’s approval. Approved access is limited to the stated purpose, scope, and duration. Emergency access requires a written reason, is disclosed to the organization owner, and remains visible in the organization’s support-access history.

08

Customer controls

Organization owners may review active and past support sessions and revoke active access at any time. Read-only grants do not permit changes. Read-and-write grants permit only actions taken for the documented support purpose, and those actions remain attributed to SitesLogix Support.

09

Availability

We work to keep SitesLogix available and will give notice of planned maintenance where we reasonably can. We do not currently offer a contractual uptime guarantee, and you should not treat the service as the only copy of records you cannot afford to lose.

10

Warranties

The service is provided “as is”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that information drawn from third-party sources is accurate.

11

Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising out of or relating to these terms is limited to the amounts you paid us for the service in the twelve months before the event giving rise to the claim.

Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

12

Indemnity

You will defend and indemnify us against claims arising from the records you put into the service, your use of it in breach of these terms, or your violation of law or of another person’s rights.

13

Suspension and termination

You may stop using SitesLogix at any time. We may suspend or terminate an account for material breach of these terms, for non-payment, or where required by law, and will give notice and a chance to fix the problem where it is reasonable to do so. After termination you have a reasonable period to export your data before it is deleted.

14

Changes

We may update these terms. If a change materially affects you, we will give notice in the application or by email before it takes effect. Continuing to use the service after that means you accept the updated terms.

15

Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
